User Agreement (Public Offer)

1. General Provisions
1.1
This document is a public offer as defined in Article 437 of the Civil Code of the Russian Federation and is addressed to an indefinite range of persons. Acceptance (acceptance) of the offer - account registration, tariff payment and/or actual use of the service, after which the contract is considered concluded (Art. 438 of the Civil Code of the Russian Federation).

1.3
Terms: 'Service' - MusicList online software service; 'User' - a person who has accepted the offer.
2. Subject of the Agreement
2.1
The Operator provides the User with access to MusicList functionality: maintaining a catalog of musical tracks/albums, release planning, search/filtering, data import/export.
2.2
The service does not store original audio files; only user content in the form of metadata (title, genre, date, statuses, etc.) is stored.
2.3
The scope of functions and restrictions are determined by the selected tariff. The tariff description is an integral part of this offer and is posted on the 'Tariffs' page of the site.
3. Registration and Account
3.1
Access requires a valid e-mail. Service notifications, receipts and subscription renewal messages are sent to it.
3.2
The User ensures the confidentiality of the password and bears the risks associated with its disclosure.
3.3
The Operator has the right to temporarily restrict access to conduct security/maintenance work, as well as block an account for violation of this offer or applicable law.
3.4
Account deletion. The User may permanently delete the account through the personal cabinet by confirming the action with a password. Before deletion, the User must independently cancel the active subscription (section 4.4). If the subscription is not cancelled, it terminates simultaneously with account deletion, and paid funds are not refunded.
4. Paid Services, Payment and Access
4.1
Payment is made through the payment partner by bank card and other methods available on the site.
4.2
Access to paid functionality is provided after successful payment for a prepaid period. After the period ends, access is terminated if the User does not pay for the next period.
4.3
Receipts. An electronic receipt is sent to the User. When using NPD mode, the receipt is generated automatically with the participation of the payment partner (when integration is enabled) or by the Operator independently.
4.4
Cancellation and Refund
4.4.1
The User may cancel the Service at any time.
4.4.2
Upon early cancellation, the Operator refunds the unused portion of the paid Subscription Period, minus any duly documented expenses actually incurred.
4.4.3
Refunds are made exclusively via the Faster Payments System (SBP) to the phone number provided by the User in the secure refund-request form.
4.4.4
The phone number is transmitted over an encrypted channel, stored in encrypted form (AES-256) and deleted once the refund is completed.
4.4.5
If an SBP transfer is technically impossible, the User shall e-mail admin@music-list.ru to arrange an alternative method; the refund will be credited within ten (10) business days.
4.4.6
The Operator voids the original receipt in the "My Tax" application, reducing the tax base in accordance with Article 8 of Federal Law No. 422-FZ.
4.4.7
Refund requests are possible only before confirmation of account deletion. After confirmation of account deletion (clause 3.4), refunds are not processed, and access to the service is terminated immediately.
4.5
Tariffs and prices. Current prices, functionality composition and restrictions are posted on the 'Tariffs' page and are an integral part of this offer. Price changes do not apply to the already paid period.
5. User Content and Restrictions
5.1
The User guarantees the legality of the posted data (metadata, descriptions) and the absence of violation of third parties' rights.
5.2
Data/actions that violate Russian law, third parties' rights, or service security are prohibited.
5.3
When deleting an account, personal data processing stops and data is deleted/anonymized according to the Personal Data Policy (link below).
6. Personal Data
6.1
PDn processing is carried out in accordance with the Personal Data Processing Policy, which contains information about PDn categories, purposes/legal grounds, storage periods, PDn subject rights, cross-border transfer (if applicable), as well as the procedure for withdrawing consent and requests.
6.2
For PDn issues, requests should be sent to admin@music-list.ru.
7. Limitation of Liability
7.1
The service is provided 'as is'. The Operator strives for uninterrupted operation but does not guarantee the absence of errors/failures.
7.2
The Operator's maximum liability for any claim is limited to the payment amount for the last paid access period.
7.3
The Operator is not responsible for failures of payment systems/communication providers/third-party software.
8. Intellectual Property
8.1
Exclusive rights to the software code, design, interface and materials of the Service belong to the Operator.
8.2
Use of Service elements outside the scope provided by this offer is prohibited without written permission.

9. Offer Changes and Notifications
9.1
The Operator has the right to change the offer by publishing a new edition on the site. Significant changes are notified by e-mail.
9.2
If the User continues to use the Service after publishing a new edition, this means consent to the changes.
10. Term and Termination
10.1
The contract is valid from the moment of acceptance until the termination of the use of the Service or termination at the initiative of either party.
10.2
The User has the right to terminate the contract at any time through the personal account (account deletion/subscription cancellation). Refunds - according to clause 4.4 of this offer.
